These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Gymbers (“Gymbers”, “we”, “us”, or “our”), governing your access to and use of the Gymbers website (the “Website”), the Gymbers mobile applications (the “App”), and any associated online communities or services provided by Gymbers (collectively, the “Services”).

By accessing, downloading, installing, or using any part of the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

1.1 The Services are intended solely for individuals who are 18 years of age or older. By using the Services, you represent and warrant that you meet this requirement.
1.2 The Services are made available worldwide, subject to compliance with applicable laws in your jurisdiction.

2. Accounts and Access

2.1 Certain features of the Services require the creation of a user account. You agree to provide accurate, complete, and current information when creating an account.
2.2 You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
2.3 Gymbers reserves the right, in its sole discretion, to suspend, restrict, or terminate access to your account at any time and without prior notice if you violate these Terms.
2.4 Guest access is permitted for browsing publicly available content on the Website.

3. Subscriptions and Payments

3.1 Gymbers offers both free and paid Services, including but not limited to subscriptions, one-time purchases, workout programs, course access, and community memberships.
3.2 Payments may be processed through third-party providers such as Apple Pay, Google Pay, PayPal, Stripe, or in-app purchase platforms. By making a payment, you agree to comply with the applicable terms of such providers.
3.3 In accordance with EU consumer law, you are entitled to a 14-day withdrawal right from the date of purchase. Refund requests beyond this statutory period shall be subject to Gymbers’ sole discretion.
3.4 Subscriptions will automatically renew unless canceled prior to the renewal date. You may manage or cancel subscriptions through your account settings or the respective app store.
3.5 Free trials may be offered for the App. At the end of the trial period, charges will apply unless canceled in accordance with the applicable instructions.

4. Intellectual Property

4.1 All content made available through the Services, including but not limited to articles, workout programs, videos, graphics, trademarks, logos, and software, is the sole property of Gymbers or its licensors and is protected by copyright, trademark, and other intellectual property laws.
4.2 You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes.
4.3 Any reproduction, distribution, modification, or commercial exploitation of Gymbers’ content without prior written consent is strictly prohibited.

5. User-Generated Content

5.1 Users may upload, post, or share content, including but not limited to photos, progress updates, comments, and workout logs (“User Content”).
5.2 You retain ownership of your User Content. However, by posting or uploading content to the Services, you grant Gymbers a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content within the Services.
5.3 Should you expressly consent, Gymbers may also share your User Content (such as progress photos or personal records) on the Website or in promotional materials.
5.4 Gymbers reserves the right to remove or restrict access to User Content at any time and for any reason, including violations of these Terms.

6. Community Guidelines

6.1 Gymbers may host official communities on third-party platforms (e.g., Discord, Facebook, Skool, X). Participation in such communities is subject both to these Terms and to the terms of the respective platforms.
6.2 You agree not to engage in any of the following:

Harassment, hate speech, abuse, or threats
Posting or promoting illegal content or activity
Medical or health advice beyond personal experience
Spam, advertising, or solicitation without authorization
6.3 Gymbers reserves the right, at its sole discretion, to suspend or permanently ban users from its communities without prior notice.

7. Health Disclaimer and Limitation of Liability

7.1 The Services are provided for informational and educational purposes only and do not constitute medical advice.
7.2 You acknowledge that participation in fitness activities involves inherent risks, including but not limited to injury, illness, or death.
7.3 You agree to consult a qualified healthcare professional before beginning any exercise program or using the Services.
7.4 To the fullest extent permitted by law, Gymbers disclaims all liability for any injury, loss, or damages arising from your use of the Services.

8. Data and Privacy

8.1 By using the Services, you acknowledge that Gymbers will collect and process personal data, including but not limited to account information, workout history, bodyweight, repetitions, and other health-related data, in accordance with applicable data protection laws.
8.2 You may delete your account at any time, after which Gymbers will erase your personal data in compliance with applicable regulations.

9. Termination

9.1 Gymbers may, at its sole discretion and without notice, suspend or terminate your account or access to the Services if you violate these Terms.
9.2 Users may terminate their account at any time through account settings.

10. Governing Law and Jurisdiction

10.1 These Terms shall be governed by and construed in accordance with the laws of the European Union and the Federal Republic of Germany, without regard to its conflict of law principles.
10.2 The courts of Munich, Germany shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

11. Amendments

11.1 Gymbers reserves the right to amend or update these Terms at any time.
11.2 Users will be notified of material changes, and continued use of the Services following such notice shall constitute acceptance of the revised Terms.
